2017 South Florida Commuter Services Challenge Official Rules

 

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. MUST BE 18 YEARS OF AGE OR OLDER TO ENTER AND A RESIDENT OF THE STATE OF FLORIDA EXCEPT WITHIN 75 MILES OF THE CITY LIMITS OF ORLANDO AND MEET ALL OTHER ELIGIBILITY REQUIREMENTS. VOID WHERE PROHIBITED.

Eligibility

The 2017 South Florida Commuter Services Challenge (the “Challenge”) begins at 12:01 a.m. EST on November 6, 2017 and ends at 11:59 p.m. EST on November 17, 2017 (the “Entry Period”). Eligible entrants must be at least eighteen (18) years of age and a legal resident of the State of Florida except within 75 miles of the City Limits of Orlando. Eligible entrants must be a student (and not a varsity basketball player) currently enrolled in one of the following colleges: Miami Dade College, Florida International University, Florida Atlantic University, University of Miami, Barry University, Broward College, Indian River State College, Johnson and Wales University, Palm Beach Atlantic, Palm Beach State College, Nova Southeastern University, McFatter Technical College and St. Thomas University. Employees of, and the immediate family members of employees of, the Released Parties (as defined in Section 4 below) their affiliates and subsidiaries are ineligible. This Challenge is subject to federal, state and local regulations.

How to Enter

To enter, download the RideFlag Mobile App (the “App”), unless you have already done so, and register on the App using your collegiate email address. Use the App to log a commute to or from your college’s campus using an Alternative Mode of transportation (as described below) during the Entry Period. To successfully log your commute as described in the preceding sentence, “tap in” using the App at the beginning of your commute and “tap out” using the App once your trip is completed. Alternative Modes of transportation are, carpooling, public transit, walking, and bicycling. Note that to successfully log a carpool at least one (1) additional individual in your carpool must simultaneously track his or her commute using the App. Once you use the App to successfully log your Alternative Mode commute to or from your college’s campus, one entry will be automatically entered on your behalf. You may submit multiple eligible entries in accordance herewith during the Entry Period with no limit. Incomplete logs (i.e., only “tapping in” or “tapping out” of a commute, but not completing both tasks) will not be accepted. Entrants will receive one (1) entry in the random drawing (described in Section 3 below) for each commute successfully completed during the Entry Period. No other method of entry is acceptable. By participating in the Challenge, participant agrees to be bound by all the Official Rules of the Challenge.

Drawing and Prize

One (1) Challenge prize winner (“Grand Prize Winner”) will be randomly selected on or about November 20, 2017 after the conclusion of the Entry Period from among all eligible entries received during the Entry Period. The drawing will be conducted by the Sponsor, whose decisions are final in all matters relating to the Challenge. The Grand Prize Winner will be awarded the following prize:

      a. $2,500 Scholarship Grant;
      b. Two (2) tickets to a Miami HEAT home game to be played in the month of December, 2017;
      c. One (1) P2 AmericanAirlines Arena parking pass for the game;
      d. The opportunity to watch the Miami HEAT’s pre-game shoot around on the playing court before the game;
      e. Recognition on the center-hung scoreboard during the game; and
      f. A gift bag with Miami HEAT merchandize, including a personalized Miami HEAT jersey.

The approximate retail value (“ARV”) of the Grand Prize is $3,250. One (1) Challenge prize winner (“Second Place Winner”) will be randomly selected on or about November 20, 2017 after the conclusion of the Entry Period from among all eligible entries received during the Entry Period except the entry of the Grand Prize Winner. The Second Place Winner will be awarded a Miami HEAT autographed basketball (ARV: $250). The drawing will be conducted by the Sponsor, whose decisions are final in all matters relating to the Challenge. Only one (1) prize per person. If no eligible entrant logs a commute during the Entry Period, Sponsor will not give away either prize. The total ARV of the prizes is $3,500. ARV of hand-signed merchandise subject to fluctuation based on the featured NBA players and current market value at the time prize is awarded. The actual value may vary and Sponsor is not responsible for any difference between the actual value and ARV. The specific game, merchandise, and all other details of the prizes will be determined by Sponsor in its sole discretion. Eligibility will be determined in accordance with these rules by the Sponsor, whose decisions are final in all matters relating to the Challenge. Odds of winning the prizes depend on the number of participating eligible entrants and the amount of entries submitted by all entrants. The Challenge winners will be notified by email or telephone. The prize winners will be required to respond to the phone call and/or email notification within twenty-four (24) hours indicating whether he/she can accept the prize. The winners may be required to complete, sign, and return an affidavit of eligibility, and/or a liability and publicity release, within twenty-four (24) hours of prize notification. Any prize notification or prize returned to the Sponsor as undeliverable will result in disqualification. In the event of prize winner non-responsiveness, forfeiture, or other disqualification, the Sponsor will only select an alternate winner once. In the event of noncompliance within any of these rules, the prize will be forfeited in connection with the relevant entrant. The Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize or any portion thereof should become unavailable for any reason. The Sponsor reserves the right to cancel, postpone, or revise the Challenge if the Challenge becomes impossible or commercially unreasonable to administrate.

Limitation of Liability

Miami Heat Limited Partnership, the Miami HEAT, the AmericanAirlines Arena, Basketball Properties, Ltd., Miami-Dade County, City of Miami, the National Basketball Association and its Member Teams, NBA Properties, Inc., NBA Media Ventures, LLC, South Florida Commuter Services, and each of their respective parent companies, subsidiaries, affiliates, advertising/promotion agencies and each of their directors, officers, employees and agents (collectively the “Released Parties”) are not responsible for lost, late or misdirected mail, miscommunications, entries, failed telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Entrants who tamper with or abuse any aspect of this Challenge, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person in relation to this Challenge, as determined by the Sponsor in its sole discretion, will be disqualified. Any attempt by a person to deliberately damage or undermine the legitimate operation of the Challenge is a violation of criminal and civil laws and the Sponsor reserves the right to seek damages from any such person to the fullest extent of the law. Released Parties are not responsible for injury or damage to participants’ or any other persons’ property related to or resulting from participating in this Challenge. The Sponsor will resolve all disputes in its sole discretion. By participating in the Challenge, each participant agrees to release, hold harmless and indemnify the Released Parties from and against any and all liability, losses, damages, rights, claims and causes of action (however named or described) of any kind resulting from or arising out of the participation in the Challenge and/or the acceptance, possession, receipt or use of any prize, including, without limitation, personal injuries, death and property damage.

No responsibility is assumed by any of the Released Parties hereunder for: any error, including typographical and/or technological error, omission, interruption, deletion, defect, delay in operation, theft or destruction or unauthorized access to, or alteration of electronic data; or any other problems in connection with the Challenge, including, but not limited to, technical malfunctions in the posting of the rules on-line or the functionality of any website or web service. Any trade names, trademarks or service marks shown as part of the materials associated with the Challenge are the property of their respective owners. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

Publicity

Entry into the Challenge and/or acceptance of a prize constitutes permission to use winners’ names, voices, biographical information and/or likeness for purposes of advertising and promotion and/or publicity purposes in all forms of media and by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed) without further compensation and/or authorization as permitted by law by the Released Parties and/or each of their respective parent companies, subsidiaries, affiliates and advertising/promotion agencies (collectively the “Publicity Parties”).

Personal Information

By entering the Challenge and voluntarily providing your personal information as described in these Official Rules, you agree to the collection and use of your personal information by the Publicity Parties for the purpose of administering the Challenge, including, without limitation, contacting you with respect to the Challenge, disclosing the list of the winner(s), and verifying your identity, eligibility, e-mail address, postal address, and/or telephone number. You further agree that your personal information may be used to send materials related to future promotions, events, and the marketing of goods and services of the Publicity Parties, but will not otherwise be disclosed to third parties, except as disclosed in the privacy policy available at www.nba.com/news/privacy_policy.html, unless otherwise required by law. If you do not want us to use your personally identifiable information in this manner, please do not provide us with this information and do not enter the Challenge.

Governing Law

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and/or entrant, will be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of Florida, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Florida.
